Trademark Protection

Register your trademark. Keep it yours for the next 10 years.

A registered brand name isn’t optional in Argentina — it’s the only thing standing between you and someone else filing it first. We handle the INPI registration, then keep watch for the full 10 years your mark stays valid: oppositions, renewal deadlines, and the compliance filings most owners forget.

Who this is for

Built for anyone with a name worth protecting

Founders naming a new company

Your company name at IGJ and your trademark at INPI are two separate registrations. Protect the name before someone else files it first.

Brands expanding into Argentina

Already selling here? Your trademark from another country doesn’t automatically protect you locally — Argentina requires its own registration.

Anyone who’s been copied before

Continuous monitoring catches copycats and confusingly similar filings while there’s still time to oppose them.

What happens after you file

The 10-year life of your trademark

Registration is the easy part. Everything on this line is what “custody” actually means — and what most owners lose track of on their own.

Month 0
You file
Antecedent search, then the application goes in with INPI.
~Month 2
Registered
If nobody opposes it, under Argentina’s 2026 fast-track process.
Year 5–6
Use declaration due
A sworn mid-term filing, separate from renewal. Miss it and you pay a penalty — and can’t renew until it’s filed.
Year 10
Renewal window
Filable from 6 months before to 6 months after expiration.
Custody runs the entire time in between — watching for infringers, tracking every deadline above, so nothing depends on you remembering a date a decade from now.

How it works

From search to registered, then watched

1

We search first

Before filing anything, we check your mark against existing registrations so you’re not paying INPI fees on a name that’s already taken.

2

We file with INPI

Application submitted in the right class or classes, under Argentina’s streamlined 2026 process.

3

You wait, we watch

Published marks get a 30-day opposition window. Nothing filed against it, and your registration is granted directly — typically around 2 months from filing.

4

Custody begins

The moment it’s registered, we start the 10-year clock: watching for infringers, tracking every deadline that follows.

Already have a Legal Representative?

Foreign trademark owners need a special domicile in Buenos Aires too — the same one your Legal Representative service already provides.

FAQ

Frequently asked questions

How long does trademark registration take in Argentina?

Under INPI’s 2026 process, an uncontested application is typically granted in about 2 months — down from over a year under the previous system. If someone opposes it, expect several months more while that’s resolved.

What exactly does “custody” include?

We monitor every new INPI Boletín for marks that are identical or confusingly similar to yours — phonetically, visually, or in translation — and flag them with a risk level so you know if it’s worth opposing. We also track your own compliance deadlines: the mid-term use declaration and your 10-year renewal.

Do I need to be in Argentina to register a trademark?

No. Foreign owners do need a special domicile in Buenos Aires (CABA) on file with INPI — we provide that as part of registration, or you can use our Legal Representative service if you already have one set up.

What happens if someone opposes my application?

INPI notifies you and gives you three months to try to reach an agreement with whoever opposed it. We handle that negotiation and, if needed, the formal response.

What is the “mid-term declaration of use” and why does it matter?

It’s a sworn statement, due between years 5 and 6 of your registration, confirming the mark is in use. It’s easy to miss because it has nothing to do with renewal — but skipping it means a penalty fee, and INPI won’t process your renewal at year 10 until it’s filed.

When do I need to renew, and what happens if I miss it?

Registrations last 10 years and can be renewed indefinitely. You can file the renewal anywhere from 6 months before to 6 months after expiration — miss that window and the registration lapses, and someone else can file for the same mark.

Can I register in more than one class?

Yes. Argentina uses the international Nice Classification (45 classes covering goods and services) — each class you need is its own registration and its own fee. We’ll help you figure out which classes actually cover what you do.

Protect the name you’re building.

Register it once, and let us keep watch for the next 10 years.
